Terms of Service
This document sets out the terms that you accept by viewing or using AirNgin's content, tools, and services, whether as a general user, a registered user, or a manufacturer, collectively referred to below as the “User.” This agreement clarifies the relationship between us, the infrastructure service provider, and you, our valued User, and may be relied upon in the event of a dispute between us, including for arbitration or adjudication before the competent legal authorities.
By registering with AirNgin and using any of our services, the User confirms that they have been informed of, have accepted, and are bound by the provisions of all three documents: the Terms of Service, the Service Level Agreement (SLA), and the Privacy Policy.
Intellectual Property Rights
We use the names AirNgin, Air Ngin, and other combinations of these words. Exclusive ownership and all material and intellectual property rights to this name, the concepts employed, the product, the service, and any content published in any form on AirNgin.com, AirNgin.ir, AirNgin.io, AirNgin.net, and any subdomain thereof are reserved to AirNgin. Any use or exploitation of them, in any form and for any purpose, whether for personal, commercial, or non-profit projects, directly or indirectly, without AirNgin's written permission, is prohibited and unauthorized. Graphical interfaces, designs and illustrations, information and data, computer code, educational texts, and other elements produced by AirNgin are examples of such published content. In the event of any unauthorized use, AirNgin reserves the right to pursue related legal claims and to enforce its rights through the appropriate legal channels.
Laws of the Islamic Republic of Iran
AirNgin operates under the laws of the Islamic Republic of Iran. Accordingly, any production or action that violates the laws of the Islamic Republic of Iran, or that uses AirNgin's services in any way to protect or facilitate such a violation, breaches the terms of this agreement. We do not permit misuse or criminal tools on AirNgin, and as soon as we become aware of the distribution or hosting of such material, we will act to stop it. In such cases, any amount paid by the customer will not be refunded.
Copyright and Other Applicable International Laws
By using AirNgin, you agree to comply with the laws of Iran, international internet conventions, and the laws and customs in force in any region where AirNgin's services are provided, and you agree not to take any action that could create liability for AirNgin in any way; should this occur, you assume all related legal responsibility. AirNgin reserves the right, at its own discretion or in response to requests, complaints, or reports from internet authorities, legal bodies, or other competent institutions and individuals, to disclose information about a user of an IP address or infrastructure, or to suspend service to a user, at any time. In such cases, amounts paid will not be refunded.
Confidential Information
By registering for and using AirNgin's products, and by storing data or routing your website's traffic through this cloud platform, you authorize AirNgin, within the framework of its Privacy Policy, to receive, review, and analyze all requests sent by the users of your site, to help prevent potential attacks, and to forward filtered content to the relevant primary server(s). Statistics and reports generated from these operations will be made available to you in your user panel.
Please also note that, because AirNgin does not have access to the programming code running on devices, it provides no guarantee regarding data protection on the device side.
Non-Confidential Information
AirNgin is permitted to process information and traffic passing through its cloud system and to use it analytically to improve service delivery, deploy new points of presence, develop its services, or for other necessary purposes, and to publish reports based on it when needed. This information will be used with due regard for confidentiality.
Please note: a judicial or administrative ruling, a lawful order, or a directive within the territorial jurisdiction of the Islamic Republic of Iran, or of any location where AirNgin operates a point of presence or server, as well as rulings issued by competent international authorities, may, as applicable, take precedence over any of the confidentiality provisions stated or implied herein, meaning that it may suspend, halt, or annul the application of any of them. In such cases, no objection will be accepted, and AirNgin will bear no responsibility in this regard.
User Account
To create a user account, you must enter your information in accordance with your official identification documents. You are responsible for any consequences of entering incorrect information into your account. If any of your information changes, you must update it in your account as soon as possible. Responsibility for entering your information correctly and completely, and for protecting your chosen password, rests solely with you; if a weak password leads to unauthorized access to your account, AirNgin bears no responsibility.
Responsibility for Password Protection
AirNgin has taken steps to prevent users from choosing overly simple passwords, but users may nonetheless use common passwords or fail to adequately protect their password. In such cases, misuse of that password could disrupt or compromise the distributed and secured infrastructure hosted on AirNgin. AirNgin accepts no responsibility in such situations.
AirNgin strongly recommends using complex passwords and avoiding sharing them, whether digitally or physically.
Digital Communications
By using AirNgin's services, you agree that digital communications, such as notices, emails, SMS messages, notifications, and support responses via “ticket,” replace traditional methods of communication such as fax, telephone, letters, and in-person visits. Accordingly, any correspondence conducted through the digital methods mentioned above will be legally valid.
Newsletter Subscription
By creating an AirNgin account, you agree to receive AirNgin's informational and newsletter emails and SMS messages. If you do not wish to receive these, you may unsubscribe; however, in that case, AirNgin bears no responsibility for your not being informed of messages sent through these communication channels.
Use of Free Services
If you use AirNgin's free services, you are not covered by dedicated support, the Service Level Agreement (SLA), or compensation for service disruption. AirNgin reserves the right to change the features and capabilities of its free tier at any time, or to discontinue it entirely, and the provision of these free services, or their continuation, never creates any obligation for AirNgin.
Please note that a Fair Usage Policy applies to AirNgin's free services and packages.
Beta / Trial Version
Those AirNgin services announced as being in “trial” or “Beta” status are not stable and should not be used by users for the production or delivery of their final, primary product. AirNgin reserves the right to make changes to its trial services at any time, or to delete data existing on these services. In the latter case, data recovery will not be possible.
Gift Codes, Discounts, and Promotions
Gift codes, discounts, and any amounts given to users as gifts through advertisements and campaigns are usable only by the specific user to whom they were issued, and cannot be sold, assigned, or transferred to another user. Likewise, these discounts, and any amounts credited via a gift code from an account top-up, cannot be refunded or settled in cash.
Additionally, when a service is canceled and a refund is requested, the value of any gift code(s) is not included in the refunded amount.
These amounts appear as a discount or gift code in your wallet or invoice, and may only be used for AirNgin's services. Every gift code issued by AirNgin has a specific expiration date, and if the user does not use it within its valid period, the code will be voided and will not be reissued.

Scope of Technical Support Services
AirNgin's technical support specialists provide support only in the area of cloud infrastructure and issues directly related to AirNgin's products, and bear no responsibility for the installation, maintenance, or troubleshooting of devices or hardware that users set up using AirNgin's infrastructure, or of any other infrastructure or software that users connect to AirNgin in any way.
Compensation for Damages
In the event of a disruption to your use of any of AirNgin's services, compensation is determined in accordance with the Service Level Agreement (SLA) and is provided in the form of credit allocated to your user account; this credit cannot be settled in cash. Credit compensation is provided only to users covered by an SLA agreement, and does not apply to users with a negative account balance or outstanding debt to the company. To make use of this option, you must submit an official letter or open a support ticket titled “Credit Service Request,” including system reports and logs demonstrating the disruptions that occurred. AirNgin bears no responsibility for compensating losses or damages, or lost potential benefits, beyond what is specified in the SLA, and will undertake nothing beyond the allocation of credit services under any circumstances.
Pricing and Price Changes
The price of all AirNgin services and products is calculated on a Pay-As-You-Go basis, on an hourly rate, and in accordance with the current pricing published on the pricing page. Any changes to AirNgin's product pricing will be announced to users via the website or email before taking effect, and from the time of the price change, charges for all customers (existing and new) will be calculated based on the new pricing.
Disclaimer of Responsibility for Manufacturers' Product Service, Support, and Warranty
AirNgin is solely a provider of cloud infrastructure services for manufacturers' devices, and bears no responsibility for the service, support, warranty, or correct functioning of those devices. Users should direct any related follow-up to the manufacturers or their authorized representatives at the point of installation.
Conditions and Process for Suspending AirNgin Services
Given AirNgin's pricing model for its products and services, users are responsible for keeping their account balance topped up. If the account balance becomes negative (i.e., usage exceeds available credit), AirNgin will send a service suspension warning to the user by email or SMS. If the negative balance continues, service delivery and access to AirNgin's products will be suspended. AirNgin bears no responsibility for any loss of user data, incorrect device operation, or any other issue arising from a failure to top up the account, whether it is the manufacturer's account or the end user's account that is in deficit.
Right to Change Reserved
AirNgin reserves the right to change, in whole or in part and at any time, matters such as technical specifications, product tiers (plans), its pricing methodology, and these Terms of Service. The latest version of these terms will be published on AirNgin's website and will be accessible to users from this same page.
